Abstract |
Background. One of the main tasks of law enforcement agencies in ensuring the economic security of the Russian Federation is the fight against corruption crimes in the field of public procurement. The relevance of countering such types of crimes is obvious, primarily, due to the fact that as a result of their commission, significant damage is caused to the budgets of different levels. The aim of the study is to identify a number of the most important challenges in detecting and investigating corruption crimes during competitive procedures in the field of public procurement. Materials and methods. The study tasks are achieved following the analysis of federal laws regulating the procedure for public procurement and judicial practice. The methodological potential includes the method of comparative legal analysis. Results. Some aspects of corruption crimes com-mitted during competitive procedures in the field of public procurement are examined, in particular, the methods of their commission and the reasons for latency. Thus, the anal-ysis enables formulating significant challenges in detecting and investigating them. In addition, the ways of solving corruption crimes and preventing criminal behavior are pro-posed. Conclusions. Most of these crimes are committed by members of criminal groups using a whole range of conspiracy measures and possessing deep knowledge in the field of public procurement. In connection with the foregoing, during preliminary investigation, investigators should consolidate their efforts with field officers and experts, and also in-volve relevant specialists. Therefore, law enforcement officers should improve methods of detecting, suppressing, disclosing, investigating and, surely, preventing such types of crimes. |
